Abstract
Ovim diplomskim radom želim prikazati značaj interdisciplinarnih vještačenja kod prometnih nesreća kojima bi se utvrdile i ocijenile sve važne činjenice u sudskim postupcima. Rad prikazuje kako interdisciplinarnim vještačenjem kvalitetno utvrđujemo same uzroke prometnih nesreća kao i njihovih počinitelja a što za cilj ima čvrste i sigurne dokaze u sudskim postupcima, što u konačnici olakšava sudu vođenje sudskog postupka ali i donošenje ispravnih presuda. Najčešće metode kod interdisciplinarnih prometnih vještačenja su prometno-toksikološka vještačenja koja se pojavljuju u gotovo svim složenim, teškim promentim nesrećama i čiji spis sadrži nalaz i mišljenje o alkoholiziranosti i utjecaju opojnih droga i lijekova sudionika prometne nesreće sa stupnjem alkoholiziranosti i utjecaja opojne droge i lijekova. Također kod svih složenijih prometnih nesreća primjenjuje se interdisciplinarno prometno-kriminalističko vještačenje kojim se izuzimaju i obrađuju svi tragovi bitni za razjašnjavanje same prometne nesreće. Kvalitetnim interdisciplinarnim prometnim vještačenjem, šalje se poruka svim počiniteljima kaznenih djela iz oblasti sigurnosti cestovnog prometa da će biti otkriveni i sankcionirani i da je gotovo nemoguće prikriti prometnu nesreću ili svojstvo u kojem je netko sudjelovao u istoj (npr. premještanje mrtvog tijela sa mjesta putnika na mjesto vozača i sl.) sa čime će se poboljšati sigurnost cestovnog prometa općenito. Vještačenje daje bolje rezultate što se prije provede a najbolje za vrijeme očevida ili neposredno nakon istog. Kad se vještačenje provodi naknadno nalaz i mišljenje će biti bolji i potpuniji ukoliko se očevidom izuzme dovoljno tragova i dokaza koji se mogu vještačiti i analizirati. Moj zaključak bi bio da je vještake različitih struka potrebno što prije uključiti u obradu prometnih nesreća a da je to najbolje prilikom samog očevida iz razloga što će se tako sačuvati najbitniji tragovi koji bi se kasnije trebali vještačiti. U radu su korišteni podaci temeljem odobrenja Ministarstvo unutarnjih poslova RH, PU Šibensko-kninske.
Abstract (english)
With this diploma work, I would like to show the importance of interdisciplinary expertise in traffic accidents in order to determine and evaluate all the important facts in court proceedings. This work shows that the interdisciplinary expertise determines the causes of traffic accidents and their perpetrators, and which has solid and safe evidence in court proceedings, which ultimately makes it easier for the court to conduct court proceedings, as well as to make the right judgments. The most common methods in interdisciplinary traffic expertises are traffic-toxicological expertise that occurs in almost all complex, difficult accidents, and whose file contains the findings and the opinion on the alcoholization and influence of narcotic drugs and drugs of participants in a traffic accident with the degree of alcoholism and the influence of narcotic drugs and medicament. A quality interdisciplinary traffic expert will send a message to all perpetrators of road traffic felony that they will be detected and sanctioned and it is almost impossible to hide a traffic accident or attribute in which someone has participated in it (eg moving a dead body from the passenger seat to place of driver, etc.), with which it will improve safety in road traffic in general. Experting gives better results when it's performed soon as possible,but it is the best during or after the investigation. When expert judgment is applied later,expert report will be better and more complete if the evidence that are excluded with investigation is good enough that can be testify and analized. My conclusion would be that experts of different professions should be involved in the processing of traffic accidents as soon as possible, and that is the best occasionally at investigation, because, the most important traces will be safed, which should expertise later. In this work data which where used, are based on approval by Ministry of Internal Affairs, police department of Šibenik.
